Your Partner Holds an Australian Student Visa: Can You Still Be Included or Added After 2 October 2026?
From 2 October 2026, new Student visa applicants generally cannot include family members — such as a partner — in their application unless a specific exemption applies. If your partner already holds a Student visa and you were included in that visa or a pending application before 2 October 2026, you may be included in a further onshore Student visa application provided your partner remains eligible to apply in Australia. You cannot be added after a Student visa has been granted under any circumstances.
What exemptions allow a partner to be included?
The following cohorts are exempt from the family member inclusion restriction: - Doctoral degree students - Nationals of Pacific countries and ASEAN member states - Fully-funded foreign government scholarship recipients - Students sponsored by the Australian Department of Foreign Affairs and Trade (DFAT) or the Department of Defence
If your partner falls into one of these categories, they may still include you in a new or further Student visa application lodged on or after 2 October 2026.
What if we are already in Australia together?
Transitional arrangements protect families already in Australia. Your partner can include you in a further Student visa application lodged in Australia if: - You were included in their Student visa or Student visa application before 2 October 2026, and - Your partner is eligible to apply for a further Student visa while in Australia (onshore exemptions apply to the same cohorts listed above, plus students affected by provider default, those needing up to 12 additional months to finish their current course, and those progressing to a higher-level course after completing their main course).
What if we lodged the application before 2 October 2026?
Student visa applications lodged before 2 October 2026 — including those that already included family members — will continue to be assessed under the rules in place at the time of lodgement. The new restrictions do not apply retrospectively to those applications.
Can I be added after the Student visa is granted?
No. The rules explicitly state that no Student visa holder can add family members after their Student visa has been granted. There are no exemptions to this rule.
What about the proposed Transfer stream and Temporary Graduate visa changes?
The Australian Government is still developing two further reforms: - A Transfer stream within the Student visa subclass for students changing education providers. Details and the effective date have not been published. - Restrictions on Temporary Graduate visa (subclass 485) applicants including family members. Details and the effective date have not been published.
Both measures remain under development. Further information will be released by official channels when available.
What should you do next?
- Confirm whether your partner’s situation matches an exemption category.
- Check if the existing family provision applies (partner’s visa or application included you before 2 October 2026).
- Use the Department of Home Affairs Document Checklist Tool to understand financial capacity and English language evidence requirements.
- For advice on your individual circumstances, contact a migration agent registered with the Office of the Migration Agents Registration Authority. Individual outcomes depend on the latest Department of Home Affairs requirements.
